Terms of Use — SpinTheWheel

1. Agreement to These Terms

Welcome to SpinTheWheel (“App,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the SpinTheWheel mobile application available on the Apple App Store.

By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. About the App

SpinTheWheel is an entertainment and random decision-making app that may include features such as:

• Spin the Wheel
• Draw / challenges
• Random Numbers
• Dice
• Coin flip
• Themes, sound, speech, and optional PRO features

The App is provided for personal, non-commercial entertainment and decision-assistance use. Results generated by the App are random (or based on user-configured options) and should not be treated as professional, legal, medical, financial, or gambling advice.

3. Eligibility

You must be able to form a binding contract under applicable law to use the App. If you are under the age of majority in your region, you may use the App only with permission from a parent or legal guardian.

If you are a parent or guardian, you are responsible for your child’s use of the App.

4. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use SpinTheWheel on Apple devices you own or control, solely for personal use, in accordance with the App Store Terms of Use and these Terms.

You may not:

• Copy, modify, distribute, sell, lease, or sublicense the App
• Reverse engineer, decompile, or attempt to extract source code (except where allowed by law)
• Bypass or interfere with security, subscription, or access controls
• Use the App for unlawful, harmful, fraudulent, or abusive purposes
• Use automated systems to scrape, overload, or disrupt the App
• Remove copyright, trademark, or proprietary notices

5. User Content and Inputs

You may create or enter content in the App, such as wheel labels, challenge text, preferences, and settings (“User Content”).

You retain ownership of your User Content. By using the App, you grant us a limited license to store and process that content on your device (and, where applicable, through service providers needed to operate subscriptions or support) solely to provide the App’s features.

You are responsible for ensuring your User Content does not:

• Infringe others’ rights
• Contain unlawful, hateful, or abusive material
• Violate applicable laws

We do not claim ownership of your wheel names, lists, or personal entries.

6. Subscriptions and In-App Purchases (PRO)

SpinTheWheel may offer optional paid features through SpinTheWheel PRO or similar subscription / in-app purchase products.

A. Billing

• Purchases are processed by Apple through your Apple ID.
• Prices are shown in the App / App Store and may vary by region.
• Payment will be charged to your Apple ID account at confirmation of purchase.

B. Auto-renewal

If you purchase an auto-renewable subscription:

• It renews automatically unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions in your Apple ID account settings:

C. Free trials

If a free trial is offered, unused portions are forfeited when you purchase a subscription, where applicable, subject to Apple’s rules. Trial availability and length may change.

D. Refunds

Refund requests are handled by Apple under Apple’s refund policies. We cannot directly process App Store refunds.

E. Restore purchases

You may restore eligible purchases using the Restore Purchases option in the App (where available), subject to Apple and subscription-provider verification.

7. Advertising

The App may display advertisements, including third-party ads. Ads may be personalized or non-personalised depending on your device settings and permissions (such as App Tracking Transparency on iOS).

We are not responsible for the content of third-party advertisements or for products/services offered by advertisers. Your interactions with advertisers are solely between you and those third parties.

PRO subscriptions, if offered as ad-free (or with reduced ads), will be described in the App at the time of purchase. Actual ad experience may vary by plan, region, and availability.

8. Intellectual Property

All rights in the App—including software, design, logos, text, graphics, trademarks, and brand elements—are owned by us or our licensors and are protected by intellectual property laws.

Except for the limited license in Section 4, no rights are granted to you. “SpinTheWheel” and related branding may not be used without prior written permission, except as needed for lawful App Store / sharing references.

9. Third-Party Services

The App may rely on third-party services, including but not limited to:

• Apple App Store / StoreKit
• RevenueCat (subscription management)
• Advertising partners

Your use of those services may also be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Results will meet your expectations
• Defects will be corrected immediately
• The App is free of viruses or harmful components

Random outcomes are for entertainment / casual decision support only.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE APP / SUBSCRIPTION IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $10.

Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless the App operator and its affiliates, officers, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any law or third-party rights

13. Termination

We may suspend or terminate access to the App (or certain features) at any time if you violate these Terms, if required by law, or if we discontinue the App.

You may stop using the App at any time by uninstalling it. Cancellation of subscriptions must be done through Apple ID settings.

Sections that by nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnity) will survive.

14. Changes to the App and Terms

We may update, modify, or discontinue features of the App at any time. We may also update these Terms. The “Last Updated” date will change when revisions are made.

Continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the App and cancel any subscription through Apple.

15. Privacy

Your use of the App is also governed by our Privacy Policy:

16. Governing Law

These Terms are governed by the laws of [YOUR COUNTRY / STATE], without regard to conflict-of-law principles, except where Apple’s App Store terms or mandatory local consumer laws require otherwise.

If you are a consumer, you may also have rights under the laws of your country of residence that cannot be waived by contract.

17. Apple-Specific Terms

You acknowledge that:

• These Terms are between you and the App operator, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation
• Apple is not responsible for addressing claims relating to the App, including product liability, legal/regulatory claims, consumer protection claims, or intellectual property infringement claims
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

You represent that you are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
